For unemployment claimants:

  • Potential eligibility or claim issues: job separation (quit, discharge, lack of work), availability, base year wages, overpayment, wage garnishment, training benefits, apprenticeship, self-employment assistance benefits, temporary total disability benefits, timeliness, due process, and more.
  • Legal representation:
      1. Assist client in the initial adjudication process before the Employment Security Department (ESD).
      2. Appeal hearing before the Office of Administrative Hearings (OAH).
      3. Draft the petition for review or response for submission to ESD’s Commissioner’s Review Office (CRO).
      4. Judicial petition for review or litigation in the courts. 

For employees (or former employees):

    • Legal advice on employment law violations such as wage and hour claims, breach of contract, unfair labor practices, wrongful termination, retaliation, invasion of privacy, defamation, false claims, whistleblowing, and more.
    • Advise on difficult workplace situations, such as discipline, alleged misconduct, unfair treatment, or investigations.  
    • Review and negotiate employment contracts and separation and release agreements. 
    • Represent client in negotiation, mediation, arbitration, settlement, or litigation.

For employers:

    • Legal advice on employment matters, either company-wide or for a particular employee.
    • Draft, review, and negotiate employment contracts and separation and release agreements. 
    • Representation in negotiation, mediation, arbitration, settlement, or litigation.  
    • Legal compliance check-up: Review employee handbook, employment policies, and workplace practices for legal compliance with state, federal, and local laws.

Workplace investigations:

    • Careful and objective investigation of alleged or suspected workplace violations. 
    • Impartial and neutral methodologies for interviewing witnesses and gathering and analyzing evidence.  
    • Furnish organized investigative report that summarizes factual findings and evidence. (Optional: Report may include investigators’ evaluation and recommendations).

Mediation services:

    • Facilitate communication during the mediation process to allow parties to develop a mutually agreeable resolution to the dispute. 
    • Assist parties in drafting a durable agreement or settlement once agreement is reached.
